Asylum law in the Czech Republic

Asylum law in the Czech Republic Abstract The thesis deals with the regulation of granting international protection to refugees in the Czech Republic. Asylum law is regulated by both the Asylum Act and the Temporary Protection Act, and given the nature of international protection, which falls under the exclusive competence of the European Union, the EU regulation known collectively as the Common European Asylum System is also important. Finally, definitions based on international law, specifically the Geneva Convention relating to the Status of Refugees, are also crucial. International protection is granted to persons who, for fear of persecution or cruel treatment, have fled their home countries, which are unable to provide them with protection, or can directly cause the persecution. In the Czech Republic, the international protection is granted as asylum, subsidiary, or temporary protection, the last of which is currently the most visible and relevant because of the large-scale refugee wave from Ukraine. This diploma thesis is focused on the activities of Czech authorities and institutions that deal with unaccompanied minors. The thesis presents relevant legal regulations and procedures that govern the staff of Authority of The Child´s Social and Legal Protection, courts and professional facilities that care for children. The work also deals with the ethical view of the topic of migration. Part of the work is the elaboration of a research survey on the basis of elaborated case studies in order to find out the reasons which the mentioned children have to leave the country of origin and which institutions cooperate in solving the situation of children in the Czech Republic.
Asylum Seekers in the Czech Republic and their employment

This thesis deals with the possibilities of employment of Asylum seekers on the labour market in the Czech Republic. I analyse this issue from the perspective of the workers of the Organisation for Aid to Refugee (hereinafter referred to as the OAR), whose task is to assist Asylum seekers on the labour market. I set three research questions, one main and two secondary. They focus on the overall perspective of the participants, the OAR workers, on the issue of employment of the Asylum seekers, to identify the barriers perceived by the participants in their efforts to integrate their clients into the labour market. I was also interested in their suggestions for possible changes that would improve the chances of the target group in the labour market. This thesis includes a qualitative research inquiry, which is conducted in the form of semi-structured interviews with participants. The results of the interviews are subsequently processed using the method of thematic analysis in order to provide answers to the research questions. Development of Czech Asylum Policy in the perspective of public policy theories

This thesis aims at the development of the Czech asylum policy from the year 2000 to the year 2016. Asylum policy is an area that isn't in the center of the public concern for most of the time and only few actors take part in this policy. However, we can say that currently, because of the events such as the refugee crisis, the asylum policy is becoming a very ongoing topic and plays a crucial role in the public discourse. For this and other reason, in this thesis I am researching the development of asylum policy, explanation and description of changes that have happened. The development of asylum policy in the period is analyzed first the terms of practical changes, that are caused by the legislative or important events. This consists of the identification of particular periods, as well as their characteristic features. The analysis is also made in the theoretical perspective: Punctuated Equilibrium Theory (PET) and frame theory are used. The PET is suitable for explaining changes in the policy process, that can possibly occur after long periods of stability. Framing is an important feature of the PET. International protection proceedings Abstract The content of this diploma thesis is a discussion of the procedural side of international protection. In order to understand this topic, it is first necessary to realize where relevant sources can be found. The sources of international law in the form of soft law will help us to understand the general principles of the area. The legal regulation valid in the Czech Republic can be found at the level of European Union legislation and at the level of national regulations of the Czech Republic. It is also appropriate to define some basic concepts. The definition of the concept of international protection proceedings with the help of the concept of a decision on international protection is absolutely essential for this work. This umbrella concept has undergone its own development in the past. The definition of the boundaries of the concept of international protection proceedings is also carried out in this work by means of the so-called other proceedings from the Asylum Act. Integration of women with international protection in the context of the State Integration Program and the creation of home

The aim of my thesis is to analyze an integration process of women with international protection. The emphasis is placed on women and their migratory experiences. I believe that the role of gender in migration and integration studies is still neglected even though women often experience very specific situations as a result of the gender roles assigned to them by patriarchal societies. I monitor the integration of women with international protection within the context of services provided by the State Integration Program. I am interested in how specific services impact research participants and their daily lives in a new environment. The trajectory of the integration process is examined from the decision to migrate, through leaving the home country, acculturative stress, first contact with Czech society, to present and future visions. One of the tools of the State Integration Program is the assistance provided in the area of housing. I pay particular attention to housing, as I consider the loss of home, the search and reformation of a new one to be key aspects affecting the integration process. The Attitudes of Students of Czech Universities to Refugees

The Bachelor's thesis deals with the issue of refugees and current attitudes of Czech university students, male and female, towards this issue. The thesis is divided into a theoretical part which is elaborated on the basis of reference sources and defines important terms that are necessary for proper understanding of the issue. This part aims to clarify the issue of refugees. It also addresses important Czech and international legislation on this topic. Furthermore, it deals with what refugees are going through when they arrive in the destination country. The practical part is elaborated in the form of quantitative research with the use of questionnaire technique. The questionnaire investigates the opinions and attitudes of Czech male and female university students to refugees and the current migration crisis and what factors influence these attitudes. The data was obtained through a questionnaire distributed electronically to respondents for 20 days during February 2017. A canonical corresponding analysis (CCA) was carried out using Canoco 5 programme to process the data. The questionnaire was sent to male and female university students in the Czech Republic. Participation was voluntary and anonymous. In the introduction, respondents were informed that the questionnaire would be used for research purposes only as part of a Bachelor's thesis. They were also informed about the Bachelor's thesis. Questions were formulated to show what the attitudes are of Czech male and female university students towards refugees. Questions were asked to discover whether the students were willing to accept refugees in the Czech Republic, provide assistance to them, and whether they were worried about refugees. It was also important for the research whether they were well informed about important terms such as "refugee" and "migrant". The following hypothesis was formulated: "Students of Czech universities who are already working and living on their own have a friendly attitude towards refugees." This hypothesis was confirmed in the quantitative research. Students who are not financially supported by their parents during their studies would accept refugees in the Czech Republic and provide them with some help. Moreover, they are not worried about refugees and are interested in the current migration crisis. The second hypothesis was formulated as follows: "Students of Czech universities who have studied abroad have a friendly attitude towards refugees." This hypothesis was also confirmed in the quantitative research. Students who have studied abroad as part of their studies would accept refugees in the Czech Republic, provide them with some help, they are not worried about refugees and are interested in the current migration crisis.

The submitted diploma thesis is focused on the refugee phenomenon and its classification among international migration issues as such, while the interest is focused mainly on immigration from third-world countries into European Union, accenting the Czech Republic. In this context, causes of growing tendency in international protection applicant and economic migrant numbers, but also responses caused by this fact, are being discussed. To enable a closer look at the multi-ethnic co-habitation character, there is secondary empirical data outlining the current situation of the majority´s relationship towards the ethnic and national plurality with regard to migration crisis given on the one hand, and determinants influencing the creation of different citizen attitudes on the other hand. Last but not least, there is some space left for chosen interactive education methods and didactic material based on them, which is useful when teaching about the controversial refugee issue in lessons of Civics.
Political persecution as a reason for granting protection in international law

This thesis focuses on political persecution as a reason for which international protection is granted. Firstly, it discusses what role persecution on political grounds has played in the past, and how the entitled person is provided with protection as a result. The following chapter assesses the way political persecution is included in the relevant international law norms, as well as European law norms, which are an important source of the legal regulation of granting international protection in the European Union. As an example of how Member States respect both international and European commitments in their national legislation, the thesis reveals the laws and regulations made applicable in the Czech Republic. The crux of this thesis centres around the interpretation of different terms which are crucial for granting international protection on political grounds. This is the imperative, determining factor of the decision-making process in individual cases. Bachelor's thesis analyses the changes in approach of the Czech Republic towards refugees. This analysis focuses on refugee flows from former Yugoslavia and current refugee crisis. Thesis compares international protection granted by Czech Republic during both crisis as well as additional activities of CR in order to help refugees. Thesis's objective is to decide whether Czech policy has pursued its national interest at the expense of the promotion of human rights.
